Information We collect from you through BRIEFING

 

If you access the BRIEFING website, data is automatically collected by your browser. This information contains data regarding

This information is stored automatically in our web server log files.

The purpose for collecting, storing and processing personal or non-personal information/data is to grant you and other users (added to your account) access to our services as well as to handle our contractual relationship with you.

 

Additionally we constantly try to improve and develop our services and its functionality which might include analysing the way how you interact with and make use of our service. We might therefore take insight into anonymized User Information only for the purpose of improving and developing our service, handling of our contractual relationship or pursuing legitimate interests. We process names, positions, company names, email-addresses and passwords in order to perform and handle the contract of use. IP addresses might also be processed in accordance with our legitimate interests to match IP addresses with IP addresses that might have misused our service in the past for fraud prevention purposes. 

 

Please note that the creation of an account is a prerequisite for signing up for and using a paid subscription to our services. Creating an account does not oblige you to purchase a paid subscription. If you decide to not sign up for a paid subscription after creating an account, your account remains available and you can use it. You can apply for a deletion of your account at any time by sending an email with your request to us.

 

If, after registering at BRIEFING, you sign up for our paid services, additionally the following personal data will be collected and processed for the purposes of concluding and fulfilling the contract with you:

 

  • First name, surname, and where applicable, company name and position
  • Address
  • Payment details
  • Tax numbers (where applicable)
  • Selected subscription option
  • Possibly other, additional data you provided during the registration process.

 

 

In order to process payments, we forward payment data to our authorised payment service provider Stripe Payments Europe Ltd., Block 4, Harcourt Centre, Harcourt Road, Dublin 2, Ireland. Where necessary, Stripe will transfer the data to Stripe, Inc., located in the USA. Further information on data protection at Stripe and compliance with GDPR can be found here. We have concluded a data processing agreement with Stripe, which allows Stripe to process the data solely in accordance with our instructions and not for its own purposes.

 

In addition to the aforementioned data, we might process further (usage-)data relevant for the provision and billing of our service, such as a registration ID, the date and time of concluding the registration, the billing period, successful or unsuccessful payment processing, log-ins, upgrades, downgrades or similar. The processing and storage of the aforementioned data is necessary for the conclusion of the contract as well as its performance.

 

If you yourself are not a party to a cost-bearing contract with us, but the BRIEFING service is provided to you, e.g. by your employer or an organisation to which you belong to or you collaborate with, the processing of aforementioned information or data might be necessary for the performance or handling of existing contractual relationships with our customers, i.e. your employer, your collaborateur or the organisation you might somehow belong to.

 

We store the data for the duration of the contract term and subsequently, if applicable, for the duration of statutory retention periods, insofar as these provide for the retention of respective types of data. We delete your account including all connected data and information if you wish to do so after cancellation of your registration if no contract handling purpose or any other legitimate interest prevails. Otherwise, we might maintain your account so that it is available to you in the event of a renewed registration without you having to register again which might be in your as well as our legitimate interest.

 

When using our BRIEFING service, please only enter content and data needed for the briefs you are working on and that you wish to transfer to our servers. The transmission of your briefing data is necessary in order to provide and offer our service. We process briefing content you or your collaborators upload or change for the time of our contractual relationship and if such contractual relationship should end, for a limited period of time subject to contractual obligations, statutory retention periods or legitimate interests.

 

We encourage you not to enter personal data of any kind within the briefs you create and the briefs you have been granted access to for collaboration purposes. For all data and information you enter into our services, we assume that you are entitled to do so and that processing of such information and data does therefore not constitute a breach of law, a violation of individual rights or a breach of other obligations that might be applicable. Therefore every person entering personal data when using the BRIEFING service, guarantees to be entitled to do so in accordance with applicable data protection regulations.

 

Please note that regarding personal data and User information that you or your collaborateurs might enter into your briefs, we merely act as processor and the person entering such information is the person responsible for data protection and in charge of compliance with data protection provisions. For this purpose and in such cases, a separate contract for data processing might be necessary. In the absence of an individually agreed contract for processing, our standard contract for data processing will apply.

Asana - We offer the facility for you to connect your BRIEFING account with Asana Inc., 633 Folsom Street, Suite 100, San Francisco, CA 94107, United States(“Asana”) to enable you to export your briefs to Asana. Asana may transfer your Personal Data to countries other than your own country, including to the United States. We have concluded a data processing agreement with Asana and Asana only processes the data in accordance with our instructions and not for its own purposes. Atlassian Confluence - We offer the facility for you to connect your BRIEFING account with Atlassian Confluence, a product of Atlassian Corporation Plc., Level 6, 341 George Street, Sydney, NSW 2000, Australia, to enable you to export your briefs to Atlassian Confluence. Atlassian Confluence may transfer your Personal Data to countries other than your own country, including to the United States. We have concluded a data processing agreement with Atlassian Confluence and Atlassian Confluence only processes the data in accordance with our instructions and not for its own purposes. Hotjar - We use a survey tool of Hotjar Ltd., Dragonara Business Centre, 5th Floor, Dragonara Road, Paceville St Julian's STJ 3141, Malta ("Hotjar"), on whose platform the surveys are stored. Hotjar uses different subcontractors, which are also partly located in third countries outside the EU. Therefore, in certain cases, there may be a transfer of your data to the USA. We have concluded a data processing agreement with Hotjar and Hotjar only processes the data in accordance with our instructions and not for its own purposes. International transfer of information you share with us through BRIEFING

 

In most cases, the information you share with BRIEFING is stored in the EU. The information you share with BRIEFING is stored in Vienna, Austria. We store your data in compliance with the EUs’ General Data Protection Regulation (GDPR).

 

In some limited cases, for example, when you export your briefs, the information you share with BRIEFING may be transferred outside of the EU by BRIEFING, for example when you export your briefs to Asana, Confluence or other collaboration platforms. These countries may have different data protection laws. We recommend you to review the privacy policy of our partners.

 

 

Children’s information

 

BRIEFING software is not directed at minors under 18, regardless of age, and We do not in any circumstance, knowingly, collect data from children. If you suspect or learn your child has shared data with us without your consent, please contact Us immediately at privacy@briefing.works. If We learn or are made aware that We may have collected data from children, we will take immediate steps to investigate and resolve such instances by deleting said data and terminating the account.
